Site Terms and Conditions

Prepared 13 October 2026 · Version 6.3 · Review draft

For all enquiries, including general correspondence, commercial business, complaints, corrections, contributions and copyright or licensing requests, email contact@gipsymothiv.com. Please identify the relevant company and subject in your message.

1. About this website and its operator

This website and Online Museum are operated by Gipsy Moth IV Limited (referred to as Gipsy Moth IV Ltd, we, us or our), a company registered in England and Wales with company number 14359855. Registered office: 62 Stakes Road, Waterlooville, Hampshire, England, PO7 5NT. Correspondence address supplied for this site: 62 Stakes Road, Purbrook, Waterlooville, Hampshire, United Kingdom, PO7 5NT. These terms cover use of our website, museum, archives, maps, models and online resources.

2. Commercial business — GM4 Legend BV

The designated party for commercial business is GM4 Legend BV, Vissershavenweg 55D, 2583 DL ’s-Gravenhage, Netherlands; Dutch Chamber of Commerce (KVK) registration number 88158128. Commercial enquiries, including licensing, sponsorship, merchandise, events and other proposed business arrangements, should be directed to that company at this address. This designation does not transfer ownership of third-party rights, make either company liable for every obligation of the other, or itself create an agency, partnership or guarantee. Before any transaction, the quotation, booking or order terms must identify the actual contracting party, price, applicable taxes, fulfilment obligations and cancellation rights.

3. Scope and acceptance

Please read these terms before using the site and retain a copy if needed. They describe the conditions on which we make the site available. Where an account, upload, purchase or other feature requires a contract, the applicable terms must be presented for acceptance at that point. Visiting this site does not by itself place an order, make a donation, acquire an ownership interest or consent to marketing. Nothing here overrides rights that cannot lawfully be excluded.

4. Other policies and transactions

The Copyright Notice forms part of these website terms. Privacy and cookie notices explain personal-data processing and tracking; they are not replaced by these terms, and these terms are not consent to optional cookies. Separate, clearly presented terms apply to any sale, booking, paid digital service, competition, donation or investment proposal. Transaction-specific terms prevail for their subject matter, subject to mandatory law. Review-site buttons, forms and demonstrations do not constitute operational booking or payment services.

5. Access, availability and changes

We aim to keep the site available and accessible but do not promise uninterrupted operation, compatibility with every device, or permanent availability of any free feature. Maintenance, technical faults, security incidents and third-party outages may interrupt access. We may make reasonable changes, correct errors or withdraw content. We will give reasonable notice of material service changes where practicable and where required by law. These terms do not remove remedies or obligations relating to a service already purchased.

6. Historical and educational information

Material is provided for general historical, cultural and educational purposes. Archives may contain incomplete, disputed or outdated accounts, historical language and differing interpretations. We endeavour to identify sources and correct substantiated errors, but do not guarantee every statement, attribution, date, measurement, transcription or translation. Distinguish original records, reconstructions, estimates, owner-supplied information and editorial interpretation. Seek appropriate independent verification before relying on information for a consequential decision.

7. Maritime safety, locations and 3D models

Nothing on this site is a nautical chart, notice to mariners, weather forecast, survey, engineering specification, training qualification or professional navigation or safety advice. Maps, voyage tracks, vessel locations and distances may be approximate or historical, and are not live tracking. Model dimensions, materials, equipment positions and 3D reconstructions may be simplified or incomplete. Do not use them for navigation, passage planning, construction, restoration, maintenance or operating a vessel without competent professional verification. A listed location does not confirm that a vessel exists there today, is open to visitors or can be boarded. Check directly with its operator before travelling; follow applicable access rules and safety instructions.

8. Permitted use and security

You may use the site lawfully for its intended purposes and subject to the Copyright Notice. Do not introduce malware, attempt unauthorised access, defeat access controls, disrupt services, impersonate others, misrepresent an association with us, or submit unlawful, threatening, harassing or privacy-infringing material. Do not scrape or extract protected content or databases contrary to applicable law or an express licence. Ordinary search indexing and accessibility tools are not prohibited merely because they are automated, provided they respect access controls and do not disrupt the service. Statutory exceptions remain unaffected.

9. Accounts and children

Where accounts are available, provide accurate required information, keep access credentials secure and notify us promptly of suspected misuse. Do not use another person’s account without authority. We may restrict a compromised account proportionately to protect its user and the service. Children may use educational resources with appropriate adult guidance. A person who lacks legal capacity must obtain appropriate parent or guardian involvement before entering a transaction or granting permissions; any feature-specific age requirements will be stated. These terms do not authorise unnecessary collection or publication of children’s information.

10. Contributions, photographs and visitor stories

Where a contribution feature is enabled and these terms are expressly accepted, you retain your rights in material you submit. You grant Gipsy Moth IV Ltd a non-exclusive, royalty-free, worldwide licence to store, reproduce, display, communicate, format, translate and make accessible that material only as reasonably needed to operate and present this website and museum. Hosting and technical providers may process it solely for those purposes. Separate permission is required for merchandise, unrelated advertising, commercial licensing or other uses outside that purpose. We will not sell your contribution under this clause.

11. Contribution permissions, moderation and withdrawal

Only submit material you are entitled to provide, with the permissions needed for identifiable people and any third-party rights. Do not upload confidential information, sensitive personal details or material you cannot lawfully share. We may decline, edit for clarity or accessibility, or remove contributions for reasonable editorial, rights, safeguarding or legal reasons; we do not promise publication. We will respect applicable moral rights and agreed credits. You may request removal through the contact details below. We will assess the request and, where appropriate, cease future public use within a reasonable period, subject to legal retention, restricted backups and any separate agreement. This does not undo prior lawful use or copies independently retained by third parties. Data-protection rights remain separate and unaffected.

12. Third-party services and links

External websites, maps, video players, archives, payment providers and software may have their own terms and privacy practices. Links and listings do not establish endorsement, sponsorship or approval. We do not control third-party content or promise its availability or accuracy. Exercise your own judgement before submitting information or purchasing from another provider. This clause does not exclude responsibility the law places on us for our own selection, representations or conduct.

13. Liability — protections that always remain

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited. Your statutory consumer rights remain intact, including rights relating to goods, digital content and services where applicable. Any limitation below applies only to the extent permitted by law and, where relevant, subject to statutory requirements of fairness and reasonableness.

14. Liability to consumers

If you use the site as a consumer, we are responsible for loss or damage that is a foreseeable result of our breach of these terms or our failure to use reasonable care and skill. Loss is foreseeable if it is an obvious consequence or was contemplated when the relevant contract was made. We are not responsible for loss that is not foreseeable. The free public site is supplied for personal and educational use; we do not accept liability to consumers for business losses arising from business use. Nothing here excludes any mandatory remedy for damage caused by digital content or permits us to avoid our own legally enforceable responsibilities.

15. Liability to business users

If you use the free website in the course of business, and subject always to clause 13, implied conditions, warranties and representations are excluded to the extent lawful. We are not liable for loss of profits, sales, revenue, anticipated savings, business opportunity, goodwill or reputation, or indirect or consequential loss arising from use of or inability to use the free site, or reliance on its content. No arbitrary monetary cap is imposed by these terms. These exclusions do not replace agreed terms for a paid service or transaction and apply only where lawful and reasonable.

16. Suspension, complaints and rights reports

We may proportionately suspend access or remove material where reasonably necessary to address a breach, security risk, legal obligation or credible rights complaint. Where appropriate, we will explain the action and allow a response, unless doing so would compromise safety, security or a legal obligation. Please send complaints, correction requests and rights notices to Gipsy Moth IV Ltd at the correspondence address in clause 1, identifying the relevant page, the concern, supporting information and a reply address. Commercial enquiries go to GM4 Legend BV under clause 2. We will consider complaints in good faith; using this process does not restrict access to courts or statutory remedies.

17. Changes and general provisions

We may revise these terms for changes in law, services or operating arrangements, identifying the revision date. Changes apply prospectively; material changes to an existing contract require any notice or consent required by law. If a provision is unenforceable, the remaining provisions continue so far as legally possible without rewriting the bargain unfairly. A delay in enforcing a right is not a waiver. These website terms do not confer enforcement rights on third parties under the Contracts (Rights of Third Parties) Act 1999 unless an express separate agreement provides otherwise.

18. Governing law and courts

These website terms and non-contractual disputes relating to them are governed by the law of England and Wales. Business users agree to the exclusive jurisdiction of the courts of England and Wales. Consumers may bring proceedings in the courts of England and Wales and, where applicable, in the courts of Scotland or Northern Ireland where they live. Consumers habitually resident elsewhere retain any mandatory protections and rights to bring proceedings in their home courts provided by applicable law. This choice does not displace mandatory consumer protections or the separately agreed terms governing a transaction with GM4 Legend BV.
